Interesting concept
However, my opinion is that is the car is Driving itself, then you would technically be Riding in the car so its not an issue, no?
 
How about this ?
A guy works in NYC , he takes his driverless Prius to work , he then hires out his driverless Prius out to UBER for the next 8 hours .

Or the guy doesn't want to pay $50 to park his Prius , so he 'self drives ' his Prius around Manhattan for the next 8 hours while he works .... The car then comes to his office and picks him up ?

Yes you can. Even if you are not "driving' the car you are still performing operations to drive the car. In order to activate the car and ready it for travel a human must turn the ignition key and press a button on the dash or key fob. This is considered "operation" in almost every state.
