Were you sitting on the jury? Have you ever served as a juror in a criminal trial? The jury was given explicit instructions as to what charges they could consider. You can’t just assign whatever charges you want to. If anything this tells me the prosecution did not present their case as effectively as they should have. Wasn't sitting on the jury obviously, but I'll venture it was a jury of the criminal's peers.
