It varies from state to state. But each state gets its quota which can't be exceeded. There are numerous sources for each states quota (ASMFC) and their local size requirements.
Problem is that most states (I don't know if ME is one) are using their freshwater definitions of what is bait. And most states consider that pork rind is bait in their fresh water regs.

Are you sure that what you saw in Shinny bay were baby black back flounder and not hog chokers? Up in Narragansett bay URI studied the decline and they found it was due to Grass Shrimp predation on flounder larvae.
