Is Anyone Using This?

can one of you swanky mods (or administrators for that matter) correct the spelling on the title of this thread? That capital N in Anyone is driving me mad.

Used to be able to change that yourself on that other bad bad site.

One additional thought; if any of you have a firearms permit of any type and you get a prescription for medical MJ, be prepared for the cops to show up at your door to confiscate your firearms. It's happened in Hawaii, among other places and it has been declared perfectly legal. I don't know whether that applies to other components of CBD or not.

you can buy CBD without a prescription...........

I plead ignorance to NY state law with respect to CBD. I was under the impression that it was available, without THC (which incidentally is also a CBD) over the counter as well as by prescription. Its was the "prescription" part I was talking about. I can't imagine how anyone would know if you were buying CBD over the counter.

But follow this, Cannabis of any type is a class 1 drug under federal law, which mean it is 1)addictive and 2) has no medically recognized use. The federal 4473 that you have to fill out to buy a gun asks you if you use any illegal or addictive drugs. You answer that question "yes" and your background check will be denied. Further the district court in Hawaii and the 9th circuit court of appeals have ruled that even if you truthfully answered no to that question on the 4473, a subsequent prescription for medical marijuana is cause for the government (in this case state government) to revoke your right to own a firearm. CBD oil is unquestionably a class 1 federal drug. Proceed accordingly.

Frankly, I'm surprised that Lord Andrew hasn't figured this ploy out yet.

But yet it's OK to have an arsenal of whatever booze you want. Go figure:rolleyes::oops:

Although a little unrelated to the topic, I wanted to post two of the questions on the applications for a pistol license from Nassau county.

4. Have you ever undergone treatment for alcohol or substance use? YES / NO
5. Do you now or have you ever tried, used, possessed or sold marijuana or its derivatives, narcotics, controlled substances, tranquilizers, anti-anxiety, anti-depression, or anti-psychotic medications? If yes and prescribed by a doctor, provide the doctor's name, address, and phone number.

I am fairly certain that you WILL be denied regardless of the diagnosis that led to a prescription if the use is recent and definitely if current.
In addition, lying on the form may constitute a crime. (A further aside: the vast majority of my 35 years working for Uncle Sam, the full time civilian job, was conducting or supervising background investigations for the national security. The FBI does not expunge arrest records, even if "sealed." Although it wasn't an automatic denial of a security clearance, when a subject "failed to list" an arrest, it resulted in a long delay in adjudication, regardless if a judge or one's attorney told them they would never have to list said arrest. ) The questions on these forms, pistol license included, ask only if you have been arrested, then indicates where you would annotate the result(s) of said arrest.

Getting back to the topic (somewhat <grin>), getting a pistol license denied, and somewhat dependent on the reasons for the denial, can result in the police coming to confiscate your long guns under the provisions of the SAFE Act. All of them.

Sheesh, on the basis of question 5 few people I went to college with in the early 70s could get a permit. I didn't inhale so I'm good. Believe that and I have a bridge you may be interested in.

40 years ago. Shouldn’t impact. It wouldn’t during top secret investigations.
