Party boat inspection (Suffolk)

On August 31st, USCG Fire Island assisted DEC,
with a productive boarding of the Laura Lee, a
party/charter boat, which makes up to three trips, per day,
out of Captree State Park. DEC had received multiple
complaints, about the boat keeping undersized Fluke and
Black Sea Bass. The boarding team consisted of two
ECOs and three USCG members. USCG conducted a
safety compliance check, while DEC concentrated on
fishing checks. Most fish were in coolers or buckets, in the
open but there were some undersized fish, hidden, in the
interior of the boat. In all, 19 undersized fish were seized.
The captain of the vessel accepted responsibility for the
undersized fish and received multiple summonses,
returnable to Suffolk County First District Court. Reports
of illegal fishing activity, from the public, to DEC and the
assistance of USCG made it possible to catch this boat
abusing NY state’s marine resources.

pequa,,,,,,,,,,,,,,,, they all should get caught and fined up there azz,,,, the boats should be taking too,,,,,,,,under size fish,, that sucks,,,,,all the years i fished on jamaica bay and around i never and my crew took anything small,, infact we threw legal fish back,,,, catch and release many times out fishing on the mojoe,,,,,, but i loved the tog to eat!! and made my tog soup 8-) ,,, pequa take care,,,,,,,,,,,,,,,,,,,,,,,,,,,,, ><)))):>

The key phrase here is "hidden on the interior". Normally the angler would be responsible for anything they keep that is illegal. It appears that DEC determined that the boat had taken possession of the fish.
I don't frequent PB's and have only fished on them a few times over the years
On the ones I have been on, the mates are always very attentive and "on top" of what's going on around the boat.
I'm sure when the bight is hot, they get overwhelmed and can't see every fish that comes aboard and put in somebody's cooler.
Regardless, I believe the boat and crew are still responsible for what's on board no differently than I'm responsible for what's onboard my boat at any given time
 
I have never been on a PB except to interview a skipper when one of his former mates joined the military and needed a TS. but it just seems that even though the skipper is always deemed responsible, that depending on where the poached fish were found, that the truly guilty could be identified.
 
Agree with George Hidden in the interior really seems like they were hiding the fish

Are the fish hidden because they are being sold? 19 fish seems like a pretty large amount of hidden fish

That is a good point. I know in Fl and Ca it is the boats responsibility. I'm thinking the majority of anglers on these boats are not die hards and need to be told the Regs. I'll guess that very few anglers, including myself, know all of the different seasons, on different parts of the Island. I know where the line is drawn in these areas where Regs are different, but should it be the anglers responsibility to know Where they are?
