Heard about this tragic headline today and tried to figure out how a pontoon boat can flip with such a tragic loss of life, involving LI folks. Well I think I figured it out, 7 people on an 18 foot Sea-Doo Switch, talk about the WORST of TWO worlds, PWC & Party Barge. In fairness, the Sea-Doo folks feel the 18 footer can handle 7???

Fatal Boat Crash On Flagstaff Lake Kills Two People

EUSTIS, Maine - A fatal boat crash this afternoon took the lives of two New York women, and another woman is in critical condition at Northern Light Eastern Maine Medical Center in Bangor.

At approximately 1:30 this afternoon, a group of seven people had left their dock and were boating in the upper reaches of Flagstaff Lake in a 2024 18' Sea-Doo Switch Pontoon boat. The boat was traveling towards Flagstaff Lake, and when they were in front of the beach area of the Cathedral Pines Campground, the bow of their pontoon boat started to go under. The driver, John Morris, age 50 of Eustis, attempted to raise the bow, but it continued to go under and the boat flipped, throwing all seven passengers into the water approximately 180 feet from shore.

Witnesses on the shore and on the lake rushed to assist those in the boat, and were able to get all seven of them to the shore. Three of the passengers were unresponsive and CPR was performed on all three.

Farhana Nasir, age 53, of Selden, New York and Kiran Akbar, age 23, of Lake Grove, New York passed away at the scene. Noor Nasir, age 22 of New York was lifeflighted to Northern Light Eastern Maine Medical where she is in critical condition.

No one in the boat was wearing lifejackets. The initial investigation indicates that alcohol is not a factor in the crash.

Pontoon boat in deadly Flagstaff Lake incident is subject of recall

The Sea-Doo Switch has the potential to capsize, the recall notice says.

The 2024 Sea-Doo Switch pontoon boat that capsized Saturday on Flagstaff Lake in Eustis, killing three people from New York, was the subject of a safety recall issued in February.

Bombardier Recreational Products, headquartered in Valcourt, Quebec, manufactures Sea-Doo products, and announced the recall for Switch pontoon boats with the model years 2022-25.

“Improper distribution of passengers and cargo weight could overload the front of the watercraft and cause instability, nosediving and possibly lead to capsizing. The condition worsens if water evacuation from the hull is not optimal. This could cause serious injuries or even death,” the recall notice said.

A Jacksonville, Florida, couple filed a lawsuit against the Canadian boat manufacturer and a dealership in February after a boating accident involving a 13-foot Sea-Doo Switch pontoon boat left their child with traumatic brain injuries.

The 15-month-old was trapped underwater when the boat encountered waves and suddenly flipped, Jacksonville Today reported.

The Switch “is prone to flipping. It is an extremely dangerous vessel,” the couple’s lawyer told the news outlet.

According to Mark Latti, spokesman for the Department of Inland Fisheries and Wildlife, witnesses saw the boat begin to go under near the beach area of the Cathedral Pines Campground.

Witnesses reported that the driver, John Morris, 50, of Eustis, attempted to raise the bow, but it continued to go under and the boat flipped, throwing all seven passengers into the water about 180 feet from shore, Latti said.

Morris’ boat was not being used in a commercial manner.

Morris declined comment when reached by a Sun Journal reporter on Thursday.

Investigators are aware of the recall, Latti said Thursday.

“We have been aware of it since the crash happened and that is part of the investigation,” Latti wrote in an email.

A boat license is not required to drive a pontoon boat. However, anyone born after Jan. 1, 1999, has to complete a boater safety course in order to operate a boat 25 horsepower or greater, Latti said.

Eustis Fire Department had a firefighter on the scene within two minutes of the 911 call, with another member of the department arriving quickly after, fire Chief Sprague Wise said Thursday. A nurse was at the campground and also helped with CPR along with others at the campground, he said.

Witnesses on the shore and on the lake rushed to assist those in the boat, and were able to get all seven people on board to the shore, Wise said. Three of the passengers were unresponsive and CPR was performed on all three.

A Babylon boat salesman has been arrested and charged with grand larceny for allegedly defrauding clients out of hundreds of thousands of dollars.

Rory P. Hogan, 60, is accused of pocketing funds he failed to pay original boat owners after brokering sales of their vessels to new clients, Suffolk County District Attorney Ray Tierney announced Monday in a news release.

Hogan’s alleged crimes took place over an 18-month period from Oct. 20, 2023 through this past April 7, Tierney said. As the owner of Riteway Marine Solutions, a dealership and full-service marina in Babylon, Hogan acquired more than 10 clients’ boats "under the pretense that he would sell the vessels on their behalf" and then pay them proceeds, according to the release.
 
Once in a while, he does have a good idea IMO, although this one may further tank the employment numbers; all those Ad Account Executives and team members will face the axe. Also to be heading to the Unemployment Office will be those TV Voice Over folks from NYC that can spout out the long list of side effects in 27 msec.

Trump Moves to Crack Down on Drug Advertising

The administration is proposing a return to a 1990s-era policy that kept most drug ads off TV. That could dent the revenues of drugmakers and major networks.

President Trump signed a memorandum on Tuesday directing his administration to revive a decades-old policy that is likely to sharply restrict advertising of prescription drugs on television.

The move reflects one of the top priorities of the health secretary, Robert F. Kennedy Jr., who has repeatedly called for a ban on drug advertising on television. The policy change threatens to dent the revenues of pharmaceutical companies.

The memorandum also stands to hit major television networks, which earn substantial revenue from pharmaceutical advertisers trying to reach older viewers.

The proposal, which would effectively reverse a 1997 policy change that opened the floodgates to a deluge of TV drug advertising, is likely to be aggressively opposed by the drug industry, which has long had the courts on its side on this issue.

Past efforts to even modestly restrict drug advertising have been blocked by the courts on First Amendment grounds. The White House said it planned to change the policy via a rule-making process.

Dr. David Kessler, who as commissioner of the Food and Drug Administration in the 1990s opposed loosening restrictions on drug advertising, said, “The approach that they are proposing to follow would in essence remove direct-to-consumer advertising from television.”

“The industry will obviously challenge this on First Amendment grounds,” he added.

The F.D.A. is sending out about 100 enforcement letters cracking down on misleading drug advertisements, Dr. Marty Makary, the agency commissioner, said in a video on social media Tuesday evening. The warnings would target traditional pharmaceutical companies as well as online pharmacies, he said.

A letter to drugmakers that the F.D.A. posted online warns about deceptive online advertisements and “undisclosed influencer promotion,” signaling a new area of focus for the agency.

The White House memorandum was originally scheduled to be announced by President Trump on Tuesday afternoon at the White House. The event did not happen, and the memo was posted online more than two hours later.

“Pharmaceutical ads hooked this country on prescription drugs,” Mr. Kennedy said in a news release. “We will shut down that pipeline of deception and require drug companies to disclose all critical safety facts in their advertising.”

The main drug industry lobby, PhRMA, said in a statement on Tuesday that the industry was committed to “responsible, accurate advertising.”

The Trump administration’s moves followed its unveiling on Tuesday of a long-awaited report on a strategy to improve the health of American children.

Among other recommendations in the report was a call for the government to ramp up enforcement of direct-to-consumer prescription drug advertising laws, prioritizing what the report called “egregious violations demonstrating harm.”
