Disappointed and confused by this decision. Have not read the actual decision, but seemed clear cut from the testimony. And cell phone data does not lie! It was in total conflict with the testimony given by almost one year.

And one witness actually contradicted the testimony of Willis and Wade.


On a different topic, but relating to cellphone data usage. For those who try to escape NY/NYC taxes with one home in NY/NYC and one in Florida (residency game) - follow closely the days rules etc.

Upon audit, they ask for calendars, documents, credit card bills, blah blah blah.

But here is where they really hang their hat.

They do not even ask for your cell bills - they subpoena the "ping" data directly from the carrier. This usually (55% of the time) sinks the taxpayer case and NY/NYC taxes plus penalties and interest are due. And then they look at every return that the statute is open. Depending on how egregious, they can and will open additional years.
