Saber rattling at best since no Pharma company would use Public Info to make a critical drug, as this would disallow any patents to begin with. IF a Pharma is using something that was actually co-developed with NIH or other governmental group, the patent rights go to both groups or a royalty is paid. At best, the US companies take advantage of the many R&D tax credits, which may be argued as "public money", but that will make for some interesting court cases. Obviously the litigation involved will be extraordinarily extensive and long...
